These Website Terms of Use (“Terms”) govern your access to and use of the public websites operated by Internet Financial Company, LLC, a Delaware limited liability company doing business as BudgetSimple and BudgetKit (“Company,” “we,” or “us”), including budgetsimple.com and its subdomains, and the content, articles, tools, and financial calculators made available on them (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. The Site is intended for adults 18 years of age or older. Your use of the Site is also subject to our Privacy Policy, available at https://www.budgetsimple.com/privacy-policy.
1. Relationship to the Master Services Agreement
These Terms apply only to the public Site. Access to and use of the BudgetSimple platform, including the customer dashboard, mobile applications, APIs, SDKs, and embeddable components, is governed exclusively by the BudgetSimple Master Services Agreement, available at https://www.budgetsimple.com/master-services-agreement (the “MSA”), and the Service Order executed between the Company and the applicable customer, and not by these Terms. If there is any conflict between these Terms and an executed Service Order or the MSA it incorporates, the Service Order and the MSA control.
If you use a service powered by BudgetSimple that is offered by one of our business customers, your relationship is with that customer, and your use of that service is governed by that customer’s terms and privacy policy.
2. Educational Content Only; No Professional Advice
The Site, including all articles, tools, and financial calculators, is provided for general educational and informational purposes only. Nothing on the Site constitutes legal, tax, accounting, investment, credit, lending, banking, insurance, or other regulated professional advice, and no professional relationship is created by your use of the Site. Calculator outputs are hypothetical estimates based on the inputs and assumptions used; they are not guarantees, predictions, or recommendations, and actual results will differ. Do not rely on the Site in making financial decisions; consult a qualified professional.
3. No Credit Repair
The Company does not provide credit repair services or credit repair advice. Nothing on the Site claims, and may not be presented as claiming, that the Company or its services can clean up or improve any person’s credit record, credit history, or credit rating. All credit-related content on the Site is provided for financial and credit education only.
4. Permitted Use and Restrictions
We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal use or your organization’s internal business evaluation. You may not: (a) copy, republish, distribute, or create derivative works from Site content except as expressly permitted; (b) use automated means, including bots, crawlers, or scrapers, to access or extract data from the Site; (c) frame or mirror any part of the Site; (d) interfere with the security, integrity, or performance of the Site; (e) use the Site for any unlawful purpose; or (f) use the Site to build or support a competing product or service.
5. Intellectual Property
The Site and all content on it, including text, graphics, logos, designs, software, tools, and calculators, are owned by the Company or its licensors and are protected by intellectual property laws. BudgetSimple, BudgetKit, and related logos are trademarks of the Company and may not be used without our prior written permission. No rights are granted to you except the limited license stated in Section 4.
6. Feedback
If you submit suggestions, ideas, or other feedback about the Site or our services, the Company may use them without restriction, attribution, or compensation.
7. Third-Party Sites and Services
The Site may contain links to third-party websites or services. The Company does not control and is not responsible for their content, terms, or privacy practices.
8. Disclaimer of Warranties
THE SITE AND ALL CONTENT, TOOLS, AND CALCULATORS ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO THE SITE, AND THE COMPANY’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW. FOR CLARITY, THIS SECTION DOES NOT LIMIT ANY PARTY’S LIABILITY UNDER AN EXECUTED SERVICE ORDER OR THE MSA, WHICH ARE GOVERNED BY THEIR OWN TERMS.
10. Indemnification
You will indemnify and hold harmless the Company and its affiliates from claims, damages, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or your misuse of the Site.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Wilmington, Delaware, on an individual basis only, and each party waives any right to a jury trial to the extent permitted by law.
12. Changes to These Terms
We may update these Terms from time to time by posting a revised version on the Site with a new Date of Last Revision. Changes are effective upon posting. Your continued use of the Site after posting constitutes acceptance. These Terms replace the prior Terms of Service dated November 30, 2024 with respect to the Site.
